Compliant Drug Disposal in VA Clinics

VIA Directive 1114 establishes the policies and procedures for disposing of patient-issued controlled substance medications established by the Veterans Health Administration (VHA). VIA Directive 1114 details the responsibilities of VA hospitals to follow the Secure and Responsible Drug Disposal Act of 2010 (Disposal Act) and Code of Federal Regulations (CFR) 21 effective September 9, 2014.

Prior to the Disposal Act of 2010, there were limited options to dispose of unwanted, unused or expired medications. This led to widespread flushing of medications and controlled substances causing substantial groundwater pollution. Improper controls of controlled substances also leads to drug diversion, contributing to the misuse and abuse of prescription medication.

21 CFR and the Disposal Act

The goal of 21 CFR is consistent with the Disposal Act, to set parameters for preventing drug diversion of controlled substances with various methods for collecting and destroying pharmaceutical waste.  Another goal consistent with the Disposal Act is to decrease the amount of pharmaceutical waste introduced into public waters through improper disposal.
